Account Holder Authorization and Agreement

NOTE: If you are a third party company that requests data from account holders, your use of this platform is covered by the Third-Party Data Services Agreement.

IMPORTANT NOTICE: THIS UTILITY DATA SHARING AUTHORIZATION AND AGREEMENT CONTAINS A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER. IT AFFECTS YOUR LEGAL RIGHTS AS DETAILED IN THE ARBITRATION AND CLASS ACTION WAIVER SECTIONS BELOW. PLEASE READ CAREFULLY.

Our service helps you share your utility account, billing, and usage data with third parties.

Eversource Energy provides a service, operated by UtilityAPI, Inc., that allows you to share your utility account, billing, and usage information ("Utility Data") with third parties that you authorize ("Authorized Persons"). This Utility Data Sharing Authorization and Agreement (this "Agreement") sets forth the terms and conditions under which we provide this service (the "Service") through our website at https://usagelinkeversourcecom.eversource.utilityapi.io (the "Site").

If you don't agree to this Agreement, do not sign it and do not use the Service.

By clicking to accept or agree to this Agreement where that option is made available or by signing this Agreement (including via digital signature) and submitting your information to us, you certify that you have read and agree to be bound by the terms and conditions of this Agreement and by our Privacy Policy. IF YOU DO NOT ACCEPT AND AGREE TO BE BOUND BY THIS AGREEMENT AND OUR PRIVACY POLICY, PLEASE DO NOT CLICK TO ACCEPT OR AGREE TO THESE TERMS OR ACCESS OR USE THE PLATFORM.

To use the Service, you must be able to form a binding contract with us.

To use the Service, you must be legally authorized to accept and be bound by the terms of this Agreement and be of a legal age to form a binding contract with Eversource Energy

If you use the Service on behalf of an entity, you represent and warrant that you have the authority to bind that entity, your acceptance of the Agreement will be deemed an acceptance by that entity, and "you" and "your" herein shall refer to that entity.

You are authorizing Eversource Energy ("EVERSOURCE") to provide a third party with access to your Energy Usage (as defined below) and or Account Information (as defined by your request) (collectively referred to herein "Energy Data").

"Energy Usage" means data related to your energy usage, including your historical and ongoing meter readings and dates, billing period dates, hourly interval data and energy charges.

"Account Information" means your account information, including your name, service address, account number, meter number, customer rate class and your contact information.

This third party has provided a statement regarding how they intend to use your Energy Data which is on your Consent page.

The information was provided by your third party regarding how they intend to use your Energy Data. Eversource Energy is not responsible for the accuracy of this information or for the actions, including but not limited to unauthorized or unlawful use or access of Energy Data, inappropriate technical and organization measures of Energy Data protection, of this third party (see "Please Read Before Giving Authorization"). Your election to share your Energy Data with this third party is entirely at your own risk.

By accepting these Terms and Conditions, you are providing us with your authorization to disclose your Energy Data to this third party. Your Energy Data would continue to be shared with this third party on an ongoing basis if you elected them ongoing access without further notice to you unless you notify us; our contact information can be found on our website or your utility bill. You can also cancel your authorization at any time by viewing your existing authorizations below and selecting "Revoke" on your Connect My Data main screen.

PLEASE READ BEFORE GIVING AUTHORIZATION

Before authorizing us to share your Energy Data with a third party, please note:

  • The sharing of Energy Data with a third party is in accordance with Ontario Regulation 633/21.
  • We do not control what your authorized third party will do with your Energy Data once we share it with them.
  • The revocation of consent shall only limit further disclosure of your Energy Data and will not oblige the third party to destroy, delete or return your Energy Data.
  • It is your responsibility to make sure that you understand and accept the terms and conditions that you have agreed to with your third party, including without limitation:
    • How they will protect your privacy and confidentiality;
    • What they can do with your Energy Data;
    • Where they store the Energy Data;
    • Whether they can share your Energy Data with anyone else;
    • How long they will keep your Energy Data; and
    • How they will destroy your Energy Data when they no longer need it, or you ask them to.
  • In no event will Eversource Energy or any of our affiliates or representatives be liable to you for any personal injury, property damage, or any incidental, special, direct, indirect, consequential, punitive or exemplary damages whatsoever, including, without limitation, damages for loss of profits, loss and/or breach of data, loss of use, or loss of business opportunity, by you or any other person or organization arising out of or in connection with your authorization, disclosure and distribution of Energy Data and personal information to third parties and/or the third parties use, disclosure, services provided or performance of any obligations in respect of such Energy Data and personal information, however caused, regardless of the theory of liability (contract, tort (including negligence), strict liability, warranty or otherwise) under or in connection with the terms and conditions authorization.

If you have any questions about what a third party will do with your Energy Data, be sure to ask them before authorizing us to share your Energy Data with them.

By clicking the check mark on the third-party consent page, you authorize Eversource Energy to share your Energy Data with this third party.
